Creator Agreement

PLEASE READ CAREFULLY. This Creator Agreement applies to users who apply to become, or who are approved as, Creators on the RequestGG platform. It supplements — and does not replace — the general RequestGG Terms of Service. To apply for or maintain Creator status, you must accept both the general Terms of Service and this Creator Agreement. If you do not agree to both, you may not apply for or act as a Creator.

1. Relationship to the General Terms of Service

This Creator Agreement (this “Agreement”) is entered into between you (“Creator,” “you,” or “your”) and RequestGG LLC, a Delaware limited liability company (“RequestGG,” “we,” “us,” or “our”). It governs your application to become, and your activities as, a Creator — a video game professional, content creator, or streamer — who lists and sells interactive video game sessions (“Sessions”) through the RequestGG website and services (the “Platform”).

The RequestGG Terms of Service (the “General Terms”) and the RequestGG Privacy Policy are incorporated into this Agreement by reference and apply to you in full. This Agreement supplements the General Terms with provisions specific to the Creator relationship and does not restate them. Capitalized terms not defined here have the meanings given in the General Terms.

Order of precedence. If there is a direct conflict between this Agreement and the General Terms with respect to a Creator-specific matter, this Agreement controls solely as to that matter. In all other respects, the General Terms continue to apply.

2. Eligibility and Application

You must be at least eighteen (18) years of age to apply to be, or to act as, a Creator. You represent and warrant that you meet this requirement and have the legal capacity to enter into this Agreement.

To become a Creator, you must submit an application, which may include your display name, a pitch, and links to your social-media profiles (such as X/Twitter, Twitch, YouTube, TikTok, and Instagram). RequestGG reviews applications and may approve, decline, suspend, or revoke Creator status at any time in its sole discretion. Approval is not guaranteed and does not create any employment, agency, or guaranteed-income relationship. You agree that the information in your application and profile is accurate and that you will keep it current.

3. Identity and Accuracy of Claims

You represent and warrant that all information provided in your Creator application and public profile — including your name, competitive rank, statistics, achievements, team or organizational affiliations, and any social media accounts or follower/subscriber counts you reference — is truthful, accurate, and belongs to you personally.

You may not:

  • Impersonate, or claim to be, any other person, including any real professional player, content creator, streamer, or public figure who is not you;
  • Use another individual’s name, gamertag, likeness, photographs, video, or any content that does not belong to you or that you do not have the right to use;
  • Misrepresent your competitive rank, statistics, achievements, team affiliation, or any credential;
  • Link to, or claim ownership of, social media accounts, channels, or profiles that are not owned and controlled by you;
  • Create or operate more than one Creator account, or operate a Creator account on behalf of, or in coordination with, another individual’s identity.

RequestGG verifies Creator applications by reviewing the social media accounts and public profiles submitted during the application process. We may require additional verification at any time, including proof of identity or proof of ownership of a linked account.

Violation of this Section is grounds for immediate rejection of your application, immediate termination of an approved Creator account, forfeiture of any pending payouts to the extent permitted by applicable law, and removal from the Platform without prior notice. We reserve the right to report suspected identity fraud, impersonation of a real person, or unauthorized use of another individual’s name or likeness to the affected individual, to the relevant platform (including Twitter/X, Twitch, YouTube, Instagram, or TikTok), or to law enforcement where appropriate.

Fans who believe a Creator profile is impersonating them or another individual, or misrepresenting credentials, should report it immediately at support@requestgg.com.

4. Independent Contractor Status

You are an independent contractor. Nothing in this Agreement creates an employment, agency, partnership, or joint-venture relationship between you and RequestGG. You are solely responsible for determining the manner and means of delivering your Sessions, subject to this Agreement, the General Terms, and applicable law. You have no authority to bind RequestGG, and you are responsible for your own equipment, internet connection, software, and third-party accounts. You are not entitled to any employee benefits, and RequestGG does not withhold payroll taxes on your behalf.

5. Payment-Account Verification and Stripe Connect Onboarding

To receive payments, you must create and maintain a connected account through our payments processor, Stripe, Inc. (“Stripe”), using Stripe Connect, and provide all information Stripe requires to enable charges and payouts (which may include identity, bank-account, and tax information). Your use of Stripe is governed by the Stripe Connected Account Agreement and Stripe’s other terms, which you must accept. RequestGG does not store full bank-account or payment-card numbers; that information is collected and processed by Stripe.

You may not accept bookings until Stripe indicates that your connected account is enabled to accept charges. You are responsible for keeping your Stripe account in good standing; if your account becomes restricted or disabled, you may be unable to accept bookings or receive payouts.

6. Your Listings: Packages, Pricing, and Availability

You control your listings. You may create and offer Packages defined by a number of games and a tier (including standard and “MVP” Packages), set the play modes you support, set your own prices, define your availability windows, and block specific dates. You may enable or disable individual Packages; only enabled Packages are bookable.

Price stability. To protect Fans, when you change your prices, those prices may be locked for a period of time (currently 24 hours) before further price changes take effect. You are responsible for honoring the price displayed at the time a Fan books.

You are responsible for keeping your availability accurate and for honoring Sessions booked during the times you make available. Listing a Session does not guarantee that any Fan will book it.

7. Session Delivery Obligations

As a Creator, you agree to:

  • Show up to and deliver each booked Session on time and substantially as described in your listing;
  • Upon a confirmed booking, promptly communicate to the Fan, through the Platform’s messaging, the lobby information and/or in-game identifiers (such as Epic ID names) necessary for you and the Fan to join and play together in the same lobby or match;
  • Conduct all MVP Session voice calls in your designated voice channel within the official RequestGG Discord server. Each Creator is assigned their own designated voice channel, and MVP voice calls must take place there;
  • Comply with the rules and terms of the games you use (such as Rocket League), Discord, Stripe, and all other third-party services used to deliver or pay for Sessions;
  • Treat Fans respectfully and refrain from harassing, abusive, discriminatory, fraudulent, sexually exploitative, or unlawful conduct;
  • Maintain accurate availability and communicate with Fans promptly and professionally through the Platform.

8. Platform Service Fee and Payouts

For each booked Session, RequestGG charges a platform service fee, which is deducted as an application fee at the time the Fan pays, with the remainder transferred to your connected Stripe account. The current split is:

Payouts are made through Stripe to your connected account. You control your own payout schedule (for example, daily, weekly, monthly, or manual) through your Stripe account settings, subject to Stripe’s payout schedules, holds, and requirements. Prices and payouts are denominated in U.S. dollars. We may change the platform service fee or fee structure prospectively by updating this Agreement or the Platform; any change applies only to bookings made after it takes effect. RequestGG is not responsible for delays or holds imposed by Stripe or your financial institution.

9. No-Shows, Refunds, Reversals, and Chargebacks

If you fail to show up to a confirmed Session (a “No-Show”), the Fan is eligible for a full refund under the RequestGG Refund Policy, subject to RequestGG’s review. When a refund is issued for a No-Show, the corresponding transfer to your connected account and the related platform fee are reversed, meaning the amount previously allocated to you for that Session is returned. You bear the cost of refunds attributable to your No-Show.

You agree to cooperate with RequestGG’s review of refund and No-Show reports, which Fans may submit within the window stated in the Refund Policy (currently 48 hours after the scheduled start time). You also agree to cooperate in resolving chargebacks and payment disputes. RequestGG may offset, withhold, or recover amounts associated with refunds, reversals, chargebacks, or fraudulent or disputed transactions from your current or future payouts, or otherwise recover them from you.

10. Reviews and Ratings

Fans may leave star ratings and written reviews after completed Sessions, which are displayed publicly on your profile together with an average rating. You may not solicit, incentivize, manipulate, or falsify reviews, submit reviews of yourself, or retaliate against a Fan for an honest review. RequestGG may, but is not obligated to, moderate or remove reviews that violate the General Terms or this Agreement.

11. Messaging, Disputes, and Moderation

Coordination with Fans takes place through the Platform’s per-booking messaging. You acknowledge that messages are not private from RequestGG: a moderator may be requested by either party, and RequestGG personnel may view the message history for a booking and participate in the conversation to help resolve disputes or enforce our terms. You agree to communicate through the Platform so that a record is available, and to cooperate with moderation and dispute-resolution efforts. A moderator’s decision does not guarantee any particular outcome.

12. Creator Content, Name, Likeness, and Promotion

You retain ownership of the content you provide for your profile and listings, including your display name, biography, avatar and cover images, and social-media links (collectively, “Creator Content”). You grant RequestGG a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, distribute, and promote your Creator Content, name, and likeness as reasonably necessary to operate, provide, and market the Platform and your listings, including in directories, search results, and promotional materials.

You represent and warrant that you have all rights necessary to grant this license, that your Creator Content is accurate and not misleading, and that it does not infringe or violate any third-party right. You are responsible for ensuring your listings comply with applicable law and the terms of any game or platform referenced.

13. Taxes

As an independent contractor, you are solely responsible for determining, collecting, reporting, and remitting all taxes arising from your earnings on the Platform. You agree to provide accurate tax information as required by RequestGG or Stripe. RequestGG and/or Stripe may issue tax forms (such as IRS Form 1099) where required by law. RequestGG does not provide tax, legal, or accounting advice, and you are encouraged to consult your own advisors.

14. Creator-Specific Prohibited Conduct

In addition to the prohibited conduct in the General Terms, you agree not to:

  • Solicit, encourage, or arrange for Fans to book, pay for, or conduct Sessions outside the Platform in order to avoid the platform service fee;
  • Misrepresent your identity, skill, rank, affiliations, or the nature of your Sessions, or operate undisclosed multiple or shared Creator accounts;
  • Engage in fraud, collusion, chargeback abuse, fee circumvention, or manipulation of bookings, payouts, reviews, or availability;
  • Use the Platform to promote competing services, harvest Fan contact information, or contact Fans for purposes unrelated to their booked Session;
  • Deliver Sessions in a manner that violates the terms of the games you use, Discord, or any other third-party service (including cheating, account sharing, or boosting where prohibited).

15. Suspension, Payout Holds, and Termination

RequestGG may suspend or revoke your Creator status, place holds on or withhold payouts, remove your listings or Content, and limit or terminate your access, at any time and with or without notice, for any reason, including suspected violation of this Agreement or the General Terms, No-Shows, fraud, chargeback abuse, impersonation or identity fraud, risk to Fans or to RequestGG, or as required by Stripe or by law.

You may stop offering Sessions and request to close your Creator account at any time. Upon termination, your right to list and sell Sessions ceases; however, you remain obligated to honor any confirmed bookings unless and until they are cancelled or refunded, and obligations that by their nature should survive — including those relating to fees, refunds and reversals, taxes, content licenses, indemnification, limitation of liability, and dispute resolution — will survive.

16. No Guarantee of Bookings or Earnings

REQUESTGG DOES NOT GUARANTEE THAT YOU WILL RECEIVE ANY BOOKINGS, EARN ANY PARTICULAR AMOUNT, OR ACHIEVE ANY VISIBILITY, RANKING, OR RESULT. The Platform is provided on an “as is” and “as available” basis as described in the General Terms, and your participation as a Creator is at your own risk.

17. Creator Indemnification

In addition to the indemnification provisions of the General Terms, you agree to indemnify, defend, and hold harmless RequestGG and its owners, members, managers, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your Sessions and the manner in which you deliver them; (b) your Creator Content, listings, or representations; (c) your violation of this Agreement, the General Terms, or any law or third-party right; (d) your tax obligations; (e) any dispute between you and a Fan; or (f) any claim that your identity, name, likeness, credentials, or Creator Content impersonate, infringe, or misappropriate the rights of any third party.

18. Limitation of Liability

The disclaimers and limitations of liability set forth in the General Terms apply to this Agreement and to your activities as a Creator, and are incorporated by reference.

19. Dispute Resolution; Arbitration; Governing Law

The dispute-resolution, binding-arbitration, class-action-waiver, and governing-law provisions of the General Terms apply to this Agreement and are incorporated by reference. Among other things, this means that disputes arising out of or relating to this Agreement are subject to binding individual arbitration and a class-action waiver, and are governed by the laws of the State of Delaware, except as otherwise provided in the General Terms. Please review those provisions carefully, as they affect your legal rights.

20. Changes to This Agreement

We may modify this Agreement at any time. If we make material changes, we will update the “Last Updated” date and may provide additional notice. Changes are effective when posted unless otherwise stated, and your continued listing or sale of Sessions after the changes take effect constitutes acceptance. If you do not agree, you must stop acting as a Creator.

21. Entire Agreement; Miscellaneous

This Agreement, together with the General Terms, the Privacy Policy, and the Refund Policy, constitutes the entire agreement between you and RequestGG regarding your activities as a Creator and supersedes any prior agreement on that subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign this Agreement without our prior written consent; we may assign it freely. Section headings are for convenience only.

22. Acceptance

By submitting a Creator application, or by listing or selling Sessions, you acknowledge that you have read and agree to both the general Terms of Service and this Creator Agreement, and you represent that you are at least 18 years old. RequestGG requires acceptance of both documents during the application process as a condition of Creator status.
